In a letter addressed to the Commission on Higher Education (CHEd) Chair, the Hon. Patricia B. Licuanan dated January 15, 2014 from Michael G. Aguinaldo Deputy Executive Secretary for Legal Affairs said that “considerations of public policy favour a continuation in public office to avoid a hiatus in the performance of government functions”.
Aguinaldo cited Lecaroz v. Sandiganbayan, G.R. No. 139872, 25 March 1999; R.A. 1387 (MSU Charter) as amended; and R.A. 8292 (Higher Education Modernization Act of 1997) that “provide no express or implied prohibition on a holdover in the position of MSU President”.
